GENERAL

These Terms and Conditions (“Terms”) comprise the Agreement between Visionary Institute of Leadership Pty Ltd (“Visionary Institute of Leadership”) Trading as Debbie Zita and The Heart Centred Way the Client (“Client”) referred to in the Services Confirmation on the front page of this Form (“Services Confirmation”) (and subsequent Visionary Institute of Leadership forms). Any other contractual terms of the Client (whether upon the Client’s order or elsewhere) which are contrary to or inconsistent with these Terms shall not apply nor shall they constitute a counter-offer. By signing the Services Confirmation in respect of the services supplied by Visionary Institute of Leadership, the Client shall be deemed to have accepted these Terms and to have agreed that they shall apply to the exclusion of all others other than any terms which are implied by law. All Goods and Services will be charged at the prices set out in the Services Confirmation unless otherwise agreed by the parties. Visionary Institute of Leadership must supply the Client with Tax Invoices in accordance with GST law.

These terms and conditions govern the sale and use of products and services sold by, Visionary Institute of Leadership to the Client. They also govern the use of the site www.Visionary Institute of Leadership.com.au

Within these terms and conditions, the following words have special meanings:

• ‘I’, ‘we’, ‘us’, ‘our’ – Visionary Institute of Leadership Pty Ltd (ABN).
• ‘the site’ – www.debbiezita.com, www.debbiezita.com.au and www.theheartcentredway.com
• By using the site our products and services you agree to be legally bound by these terms, which shall take effect immediately on your initial use of the site. If you do not agree to be legally bound by all the following terms, please do not access the site, products and services.

If you are under 18, you may only access the site or purchase products and/or services from us with the involvement and consent of a parent or guardian.

SERVICES

We will work on the mutual understanding that you are fully and solely responsible for your life and Business.  I offer advice and techniques based on my own professional and personal experience.

Any decisions about a specific action or course of actions are yours and you accept full responsibility for the outcome of those actions.

All documents shared with you during the course of this program are subject to copyright and remain the property of Debbie Zita. 

Standards of Behaviour

During any sessions, you will be treated with respect and Visionary Institute of Leadership will not abuse the trust that you put in us. In return, you undertake not to harm yourself, or any other person, including any employee or contractor of Visionary Institute of Leadership, or any property belonging to Visionary Institute of Leadership or any other person.

Sessions

Each session lasts approximately one hour to one and a half hours depending on the type of program you have confirmed. Please allow one and a half hour’s so you won’t feel rushed.

We respect you, please respect us by ensuring that you arrive to sessions on time and ensure that you have a quiet space where you can be uninterrupted (this allows us to work more deeply and thoroughly).

Your package is for coaching (this includes but is not limited to activities such as goal setting/ mediation/ accountability tasks and therapeutic work including but not limited to Cognitive Behavioural Therapy (CBT), Psychotherapy, Reiki, Neuro Linguistic Programming (NLP), Family Systems Work).  At no time should the coaching replace a medical professional or advice from a tax agent/ accountant. 

If at any time you are unsure or unclear about the process/ progress of your sessions, Bring these to the immediate attention of your practitioner so that these may be remedied immediately.

Payment Policy

• On completion of the “Services Confirmation” a non-refundable 20% deposit will be required.

• The balance will be required in full at the prior to the commencement of your program, this can be paid by cash or credit card or:

The balance can be paid by regular instalments. These instalments can be weekly, fortnightly, monthly or quarterly, and can be discussed and agreed on at your consultation. This option includes a third-party business – PaySmart and additional fees may apply. Ensure you have enough money allocated in your nominated account. Credit card bounces incur a 5% admin fee. 

Cancellation Policy

If you wish to cancel an appointment or are otherwise unable to attend, you will need to give at least 48 hours’ notice otherwise the full cost of the session will be payable.

Refunds/Guarantees

No guarantees as to the effectiveness of our systems for your individual program are made or implied, as it is impossible to guarantee human behaviour or compliance.

Once your program has commenced no refunds will apply.  If you are unable to attend scheduled sessions (and have provided adequate notice) you will still gain great benefit and value from the online classes and events. You will receive all recordings of online classes and events (even if you did not attend).  You may notice that some months you have more coaching sessions than other months. This is because the process is results based not time based. Furthermore, it is important to note that we follow the philosophy of the 4 stages of the economic cycle. These are expansion, peak, contraction and trough.  We also place a strong emphasis on self care and believe that as your business is growing so too are you. You may be advised to partake in less formal coaching and instead dedicate time to self care activities such as rest, reading etc.  This is due to the fact that this time of recovery is also a time of inspiration and creativity which is a must for a business. We do offer our efforts to help you to the best of our abilities and we sincerely want you to succeed!  We also welcome your feedback.

Inability to Continue

In the event of your inability to continue your program due to sickness or ill health, you can discuss your options with your consultant. Every client will be treated on an individual basis.

Termination of Services

We reserve the right to refuse, and/or terminate, service to anyone, for any reason, at any time.

COPYRIGHT AND INTELLECTUAL PROPERTY

Use of our Products

Our products may only be used for your own personal, non-commercial home use.

• You may not use any of our products for any commercial purpose.
• Unauthorised copying, public performance, broadcasting, hiring or rental of any of our products or recordings is strictly prohibited.

Use of the Site

• You may not copy, reproduce, republish, download, post, broadcast, transmit, and make available to the public or otherwise, Visionary Institute of Leadership content in any way except for your own personal, non-commercial use.
• You also agree not to adapt, alter or create a derivative work from any Visionary Institute of Leadership content except for your own personal, non-commercial use.
• Any other use of the site content requires prior written permission from Visionary Institute of Leadership.

Privacy

Please see our Privacy Policy which is incorporated into these Terms of Use by reference. By using this website, you acknowledge and agree that you have read and accept the terms of that privacy policy.

Third Parties

We may provide links to other websites. We do not assume any responsibility or liability for the actions, products, and content of any of these external websites and any other third parties.

Indemnity, Disclaimers and Limitation of Liability

You shall indemnify and keep indemnified and hold harmless, Visionary Institute of Leadership its officers, employees and related bodies corporate (as that term is defined in the Corporations Act 2001) from and against any and all claims, actions, demands, loss, damage, injury or other liability suffered, together with all legal fees and costs which they may incur resulting from my involvement in the agreed treatment program described in the attached Services Confirmation:

Governing Law

This Agreement is governed by and is to be construed in accordance with the laws applicable in the State of Victoria and the parties submit to the non-exclusive jurisdiction of the Courts of that State.

Change of Terms

We reserve the right to change or amend the terms and conditions of this agreement as needed without prior notice.
